Terms & Conditions

These Terms and Conditions govern your use of www.simmocompressors.co.uk and your relationship with Simmo Compressors Limited.

1. Preface

Unless otherwise accepted by written agreement with Simmo Compressors Ltd. only these present terms and conditions are accepted.

2. Duties

On Placement of an order, by acceptance of a written quotation, the parties acknowledge that they are and intend to be legally bound by the terms herein.

3. Orders

Simmo Compressors Ltd reserves the right to charge postage.

4. Shipping

Simmo Compressors Ltd accepts no liability for damage incurred after the goods have been signed for/accepted by the buyer.

5. Complaints

The buyer must examine the integrity and conformity of the goods immediately after the arrival and before they are used or altered in any way. Any complaints must be made in writing and sent within fifteen days of delivery date. Claims for damages because of defective goods are peremptorily denied. No disputes shall give the buyer the right to suspend payment of supply. Under no circumstances shall the buyer have the right to raise objections regarding supply unless has the right to raise objections regarding supply unless goods are paid in full.

6. Merchandise Returns

Each return of goods must be previously authorised by a written agreement form Simmo Compressors Ltd, within 30 days. Good must be accompanied by a written description of the reason for the return in accordance with current laws. Returns because of wrongful order of for reasons not chargeable to Simmo Compressors Ltd will only be accepted if the goods are returned to Simmo Compressors Ltd in their pre-delivery condition. If the relative goods are found to be in perfect condition, they will be credited to the buyer at the invoiced value plus 22.5% as a contribution to checking and re-warehousing costs and administrative expenses.

7. Payments

Payments must be made in accordance with the relative invoice conditions. When the payment date indicated has passed, Simmo Compressors Ltd reserves the right to charge interest at Bank of England base rate plus 8%. The parties agree that any default in payments will end any agreement to pay by instalments, and the full contractual price will become due immediately.

8. Reservation of Ownership

Simmo Compressors Ltd shall have exclusive ownership of the delivered merchandise until payment has been made in full.

9. Warranty

Simmo Compressors Ltd policy is one continuous development and as such reserves the right to change the specifications of its models at any time

Simmo Compressors Ltd will not be liable if the purchaser has failed to adhere to the instructions contained in the manual or on any instruction labels on the machine, or if the machine has been abused, interfered with, altered, repaired or serviced by any unauthorised party or not been installed in a fit environment. This may result in the operating progress of the equipment being impaired and consequently the warranty becoming void.

10. The 5 year pump and motor warranty motor covers normal wear and tear

Subject to yearly servicing at a cost to the customer

11. Exclusions (for 5 year pump and motor warranty)

  • Fire, flood, theft
  • Failure for yearly servicing
  • Compressor drain being left open & continously left running
  • Any air leaks in the system of the surgery making compressor continously run
  • Any damage or misuse from the operater resulting in user error
